Welcome to The Iconic Beverage Company (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, whether through desktop or mobile access (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. ELIGIBILITY

You must be at least 18 years old to purchase products from our site. By using our Products and Services, you represent and warrant that you are of legal age and capable of entering into a binding contract. 

2. PRODUCT INFORMATION 

We strive to ensure all product details, descriptions, and prices are accurate. However, we reserve the right to refuse orders where product information has been misrepresented, including errors in pricing or availability.

All products are subject to availability and seasonal variation. We reserve the right to discontinue or modify any product at any time.

3. ORDERS AND PAYMENT

  • Orders are subject to acceptance and availability.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud or violation of these Terms.
  • Prices are displayed in South African Rand (ZAR) and include VAT where applicable.
  • We use secure third-party payment processors. By submitting your payment, you agree to their terms and privacy policies.

4. SHIPPING AND DELIVERY

We aim to dispatch all orders within 3–5 business days. Delivery timelines may vary based on your location and external factors beyond our control.

Shipping fees and available options will be displayed at checkout. You will receive a confirmation email with tracking once your order ships. 

5. RETURNS AND REFUNDS

Due to the nature of our product (consumables), we do not accept returns unless the item is damaged or defective. If you receive a damaged product, please contact us within 7 days of delivery with your order number and photographic evidence.

Approved refunds will be processed within 7–10 business days via your original payment method.

6. ORDER CANCELLATIONS 

We can only cancel an order if it hasn't been processed by our fulfillment partner. Orders must therefore be canceled within 30 minutes of being placed, otherwise our return and refund procedures will need to be followed.

7. INTELLECTUAL PROPERTY 

All content on our website — including logos, product names, descriptions, packaging designs, and imagery — are the intellectual property of The Iconic Beverage Company. You may not copy, reproduce, modify, or distribute our content without prior written permission.

8. USER CONDUCT

You agree not to:

  • Use the Products and Services for unlawful purposes;
  • Interfere with or disrupt the operation of the website;
  • Impersonate another person or misrepresent your identity;
  • Attempt to access systems or information not intended for you.

9. PRIVACY

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Products and Services, you agree to the collection and use of information as outlined in our Privacy Policy.

10. LIMITATION OF LIABILITY 

To the fullest extent permitted by law, The Iconic Beverage Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our Services or products.

11. INDEMNITY

You agree to indemnify and hold harmless The Iconic Beverage Company, its directors, employees, and affiliates from any claims, liabilities, losses, or expenses arising from your use of the Services or breach of these Terms.

12. CHANGES TO TERMS

We may update these Terms from time to time. Any changes will be posted on this page with the revised date. Continued use of our Services after changes constitutes your acceptance of the updated Terms.

13. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
